Buyer Terms & Conditions

By purchasing an artwork from an artist through Delorem, you agree to the terms below. These conditions are designed to keep the relationship between creator and collector transparent, fair, and clear.

1. Authenticity & Ownership

Originality

You are purchasing an original work of art created by the Artist.

Transfer of Title

Ownership of the physical artwork passes to you only after the Artist has received payment in full.

2. Intellectual Property

Physical vs. Legal Rights

You are buying the physical object, not the right to reproduce it. The Artist retains all copyrights to their work, design, and art pieces.

Usage Restrictions

You may display the artwork in your home or office. You may not scan it, photograph it for commercial use, or print copies for resale or promotion without a separate written license from the Artist.

3. Condition & Visual Accuracy

Digital Representation

You understand and agree that Delorem uses commercially reasonable efforts to display the colors of original works, digital works, and printed works accurately via the services. Because individual monitors may display colors differently, Delorem is not responsible for color accuracy and disclaims liability in this regard.

Handmade Nature

Minor imperfections are often a natural characteristic of original art and are not considered defects.

Care Instructions

You agree to follow any care instructions provided, including guidance on sunlight, humidity, or handling. The Artist is not responsible for deterioration caused by improper display or handling.

4. Payment, Shipping & Risk

All-In Costs

The listed artwork price does not include shipping, insurance, or international customs duties unless explicitly stated. These costs are the Buyer’s responsibility.

Insurance

Delorem strongly recommends selecting insured shipping. If artwork is lost or damaged during transit, the risk of loss passes to you once the item is with the carrier.

International Sales

You are the importer of record and are responsible for any VAT, customs duties, or import taxes required by your country.

5. Final Sale & Returns

Final Sale Policy

All purchases of artwork are final. Refunds, returns, or exchanges are not offered for buyer’s remorse, aesthetic changes of heart, or a change of mind after purchase.

EU Consumer Law Disclosure

Under the EU Consumer Rights Directive (2011/83/EU), consumers generally have a 14-day right of withdrawal for goods bought online. However, that law does not automatically apply here when the artwork is sold by a private individual acting outside a professional trade or business.

  • EU protections apply specifically to traders, meaning businesses or professional sellers.
  • Consumer-to-consumer transactions are governed by general civil contract law rather than standard consumer return statutes.
  • There is therefore no legal obligation for the Seller to accept a return unless the item is materially not as described.

As-Is Condition & Inspection

The Buyer acknowledges that art is subjective and that monitors and phones may display slight color variations compared with the physical work. The Buyer is responsible for reviewing all listing photos and descriptions before purchase and accepts the artwork in its current as-is condition.

Limited Exceptions

The no-return policy is upheld except where the artwork is fundamentally different from the listing, for example if the wrong artwork is sent or dimensions are significantly incorrect.

  • Claims for not-as-described items must be made within 48 hours of delivery.
  • Clear photographic evidence of the discrepancy must be provided.

Shipping Damage Claims

Once the artwork is handed to the shipping carrier, final-sale status applies. Damage during transit must be handled through an insurance claim with the carrier, not as a return to the Artist. The Buyer must retain all original packaging to satisfy inspection requirements.

Damaged Goods

If the work arrives damaged, you must document the damage with photographs, including the packaging, and contact Delorem within 48 hours of delivery.

6. Future Resale

Artist Credit

If you choose to sell the piece in the future, you must credit the Artist as the creator.

Resale Royalties

Depending on your location, including the UK or EU, a resale royalty right may apply and may require a percentage of future resale value to be paid back to the Artist.

7. Legal Guarantee

Under EU rules, if goods turn out to be faulty or do not look or work as advertised, the seller must repair or replace them at no cost. If that is impossible or cannot be done within a reasonable time and without significant inconvenience, you may be entitled to a full or partial refund.

  • You always have the right to a minimum 2-year guarantee from the date you received the goods, although national rules in your country may give you extra protection.
  • The 2-year guarantee period starts when the goods are delivered.
  • If a defect becomes apparent within 1 year of delivery, you do not need to prove it existed at the time of delivery unless the seller proves otherwise. In some EU countries this reversed burden of proof lasts 2 years.
  • Goods bought from private individuals are not covered by these statutory guarantee rules.
